Effective March 17, 2014 individuals with a 100 percent permanent and total (100% P&T) disability compensation rating from the Veterans Affairs (VA) will receive expedited service through all levels of the application, adjudication, and appeal process when filing with the Social Security Administration. This procedure is similar to that currently used with terminal illness (TERI) cases. Expedited claims processing applies to all veterans with a 100% P&T VA disability compensation rating, it does not apply to veterans with a 100% P&T VA disability pension rating. The VA rating only expedites Social Security (SS) disability claims processing and does not guarantee an allowance for disability benefits. These veterans must still meet SS eligibility and entitlement requirements for a disability allowance. The VA Notification Notice indicating a disability compensation rating of 100% P&T is required proof. The original VA Notification Letter, a photocopy, or a facsimile is acceptable (i.e., certification is not required). Other documents that signify proof of a permanent VA disability and 100% P&T compensation rating: VA statement that the veteran is rated 100% disabled. VA statement regarding basic eligibility to Dependents Educational Assistance (DEA) benefits. VA Form 22-5490 - Dependents Application for VA Education Benefits. VA Form 21-8760 – Additional Information for Veterans with Service-Connected Permanent and Total Disability. Note: Expedited claims processing does not apply until we receive the VA Notification Letter or proof of the VA disability compensation rating of 100% P&T. NOTE: This is not to be confuse 100% P&T veterans’ claims with Military Casualty/Wounded Warrior (MC/WW) claims that require an active duty injury, illness or wound incurred on or after October 1, 2001. This workload has separate processing guidelines.
