Elder Abuse Conference Adelaide Convention Centre 17 - 18 June 2013 Eileen Webb attended this conference. The conference, organised by ARAS (Aged Research and Advocacy Service) provided an excellent overview of many issues impacting on an ageing Australia. From a consumer law perspective there was discussion about the failure of aged care facilities to deliver an adequate standard of care to residents. This issue is not new and has been the subject of recent discussion and media attention: Adele Horin adelehorin.au/tag/elder-law/ Rodney Lewis: agedcarecrisis/legal-issues-column/an-alternative-to-the-resolution-of-aged-care-disputes Lateline 21 May 2013 abc.net.au/lateline/content/2013/s3764436.htm A question often asked is why the Australian Consumer Law is not utilised? The consumer guarantee provisions would seem an obvious place to start. While there is a complaints process under the Aged Care Act, this has, on some views, unsatisfactory outcomes. This is an important debate and more legal research in the area is recommended.
