The MVA is looking for one or two more people to consider joining our impending Election Lawsuit which seeks to challenge Minnesotas current system of Election Day (Voter) Registration. We are seeking to talk to persons who plan on registering on election-day. Our lawsuit will attempt to force the state to check the eligibility of everyone who registers on election-day prior to counting their votes. Currently, in Minnesota, the state counts those ballots and then, after the election when it is too late, determines if any of those voters are ineligible. As many of you may know, our Data Practices Act requests have discovered that after the 2008 election, there were over 500,000 persons who registered on election day, and later, when their data was entered into the into the State Wide Voter Registration system (SVRS) and then compared to lists of known ineligible voters and sent Postal Verification Cards (PVC), 48,000 could not be positively identified as being eligible to vote by the Minnesota Secretary of State. Simply put, our lawsuit seeks to require the state to conduct those checks PRIOR to counting the votes. Provisional ballots, which are used in 44 other states, would solve this problem and would place the state in compliance with the Minnesota Constitution, which we believe, does not allow the state to permit known ineligible voters to vote. What we are asking is that if any of you intend to register to vote on election-day (either for the first time or, for example, because you have moved), we would appreciate talking to you to see if you are willing to proceed to do that in a particular manner that will provide us with powerful testimony in the lawsuit.
