Email sent to:Coleshill C of E Primary School A school which asks children to wear High Vis Vests if the child has identified special needs. Following a recent post on Facebook which we ran to over 75,000 parents we asked the question: Some schools have been making children with Special needs wear High Vis Vests in the playground so they can be identiied easily... Is this something your childrens school do and what are your thoughts? What would be your feelings if they did? Please share this post and if schools are named we will contact if requested and ask them to review this policy. A parent of a child in your school has identified your school as being a school which undertakes this practice Please may i remind you of the important regulations covering issues of this nature: 11 Discrimination against disabled pupils and prospective pupils (1)In Part 4 of the Disability Discrimination Act 1995 (“the 1995 Act”), before section 29, insert the following section— “28B Meaning of “discrimination” (1)For the purposes of section 28A, a responsible body discriminates against a disabled person if— (a)for a reason which relates to his disability, it treats him less favourably than it treats or would treat others to whom that reason does not or would not apply; and (b)it cannot show that the treatment in question is justified. Also under the disability discrimination act you are required to make reasonable adjustments to make a persons life comfortable and allow the person to be treated in the same manor as a person without the additional needs. Whilst the basic foundation of this policy maybe to protect children in your care there are other reasonable adjustments you make which would avoid highlighting a childs needs in the way you are doing. 1)Maybe the childs nominated support staff could be in the playground at break time as if a child has support in place funding is also to cover break times and lunch times. Whilst this maybe an oversight on behalf of your school we feel that this practice could be challenged legally and will make representations to the local authority and local press to gather there view on this policy.
