Even though the Fair Sentencing Act (FSA) in regard to the United States Sentencing Guidelines was made retroactive to prisoners, there are some prisoners that are forced to remain in prison (and some will never be released) despite the fact that the prisoners may qualify for a reduced sentence of no imprisonment. And even though the aforementioned aspect of the crack law has been made retroactively applicable to prisoners, ultimately, the judge has the discretion to decide whether or not to reduce a prisoner’s sentence. There are some prisoners that have been denied the opportunities to be resentence in accordance to the new crack cocaine guidelines, but instead, they must remain in prison under a law that Congress and the President have deemed to be unjust. So when the politicians ask you to vote for sentencing reform, it is not always as it seems. Mass incarceration is a money maker! #massincarceration
