Ex-Vanderbilt player’s lawyer tries to keep charges out By SHEILA BURKEAssociated Press NASHVILLE, Tenn. (AP) – The lawyer for a former Vanderbilt football player accused of rape is fighting to keep jurors from hearing allegations that the defendant urinated on an unconscious co-ed during the attack. Brandon Vandenburg and Cory Batey are being tried this week for rape. They and two other former players who are charged have pleaded not guilty. A prosecutor told jurors that Batey made a racial statement and urinated on an unconscious coed in a dorm. But Bateys lawyer called that an inflammatory, uncorroborated allegation that jurors should not have heard. The judge ruled Wednesday that jurors would not hear about the alleged racial remark because the crime did not have racial overtones. Three of the ex-players are black and one is white.
