FEDERAL ROAD SAFETY COMMISSION NEW NUMBER PLATES ILLEGAL - COURT On the illegal act by the FRSC, the judge, Justice James Tsoho ruled that, ....the act of the respondent (FRSC) amounts to an arbitrary use of power, and is therefore illegal and unconstitutional. Nigeria is a country where arbitrary laws and rules are pronounced and enforced by government agencies and parastatals without any enabling legislation(s). It is all about the extortion of money from the unsuspecting public. Hope this ruling will make agencies like the Federal Road Safety Commission to sit up and only carry out duties which are clearly stated in the Acts establishing them. It should also be pointed out here that, FRSC is also in breach of their enabling Act, by getting involved and carrying out training of drivers for corporate bodies/organisations and government, thereby being the Regulator and at the same time an Operator in the Driver Training Industry. This action equates to, for example, the Central Bank of Nigeria, the regulator of the Banking Industry, turning round to be an operator in the same industry they regulate, by owning and running Commercial or Mortgage Banks. This will definitely be against the principles of best practice. With this car number plates ruling, the FRSC should stop and desist from being an Operator in the Driver Training Industry, as their continued breach will bring about further law suits. ALL OUR LEGAL FRIENDS AND LAWYERS SHOULD PLEASE ADVICE ON IMPLICATIONS OF THE CONTINUED INVOLVEMENT OF FRSC IN THE DRIVER TRAINING INDUSTRY, A SECTOR THEY REGULATE. THE IMPUNITY BY GOVERNMENT AND THEIR AGENCIES MUST BE CHALLENGED IN THE COURTS. LET RULE OF LAW PREVAIL.
