Fully aware of the growing role of our students in the school and state activities. REALIZING the fact that the above aspiration among others can be better achieved through a common and united front. HEREBY PROVIDE for a constitution for the purpose of promoting the good representation and welfare of all Epe indigent students in OGSCOHTECH on the principle of Freedom, Equity and Justice. May God help us. CHAPTER I GENERAL PROVISION PART I FEDERATION OF EPE DIVISION STUDENTS ASSOCIATION SUPREMACY OF THE CONSTITUTION SECTION 1: Supremacy of the Constitution Sub-Sec 1. This constitution shall be supreme and its provisions shall be binding on all members of the association subject to the FEDSA NATIONAL Constitution, Laws of Lagos State and the Federal Government of Nigeria. NAME, MOTTO AND LOGO OF THE ASSOCIATION SECTION 2: Name, Motto and Logo of the Association Sub-Sec 1. The Association shall be known, called and addressed as Federation of Epe Division Students Association(herein referred to as FEDSA). Sub-Sec 2. The motto of the Association shall be “Uplifting Our Cultural Heritage” Sub-Sec 3. The logo of the association (as shown below) shall have the following connotations: a) the two concentric circles represent the power of the association and shall stand for unity with a common objective. b) the canoe shall stand for equity. c) the palmtree shall stand for justice. d) the fish represents the major occupation in Epe division. AIMS AND OBJECTIVES OF THE ASSOCIATION SECTION 3: Aims and Objectives of the Association shall be Sub-Sec 1. (a) To promote the social, intellectual and cultural heritage of the division. (b) To promote the good image of the division. (c) To promote the development of the members socio-politically. (d) To enhance capacity development among student population through the promotion of training opportunity for newly elected students leaders. (e) To organise civic education programmes through seminars, symposia, lectures and rallies on OGSCOHTECH campus and outside the campus after due processes. (f) To promote cordial relationship with other divisional association. (g) To defend her members against all forms of vicitmization. (h) To promote platform for monitoring the Associations elections and intergrity of leadership in accordance with this constitution. (i) To promote general interest of her members. Sub-Sec 2. (a) These objectives shall be pursued independent of all political and religious sentiments. SECRETARIAT OF THE ASSOCIATION SECTION 4: Secretariat of the Association Sub-Sec 1. The secretariat of the association shall be on the Main campus (ie OGSCOHTECH Ojo). Sub-Sec 2. The Secretariat shall be managed by the General Secretary of the association in conjunction with the Assistant General Secretary. Sub-Sec 3. All correspondence shall be addressed to the Secretariat and all correspondence shall emanate from the secretariat. MEMBERSHIP SECTION 5: Membership Sub-Sec 1. The Association shall consist of the following classes of members: (a) All duly matriculated students who are from Epe Division(Ikosi-Ejirin, Epe-central, Eredo, Ibeju and Lekki) in Lagos State college. Sub-Sec 2. For the purpose of Section 5 (1) a, duly matriculated shall students include: (a) Undergraduate Students Sub-Sec 3. Members of the association shall forefit their membership if: (a) A student has graduated from the college or running an extra year. (b) A student has been found to be a member of a Secret Cult. (c) A student has been rusticated or withdrawn from the college. RIGHTS OF MEMBERS SECTION 6: Rights of Members Sub-Sec 1. Every members of the association shall (a) Have such right to enjoy any facility of the association subject to the provision of this constitution. (b) Be entitled to participate in Congress, organised meetings and functions of the association. (c) Have the right to vote and be voted for in the association election. (d) Have the right to information as it relates to the association. (e) Be entitled to the association package which shall include but not limited to the association identification Card and a copy of the FEDSA constitution. (f) Be entitled to partake in and append his signature at any referendum organized by the union. (g) Have the rights as may be determined by the association from time to time. PATRON SECTION 7: Patrons Sub-Sec 1. The Federation of Epe Division Students Executive Council (herein referred to as FEDSEC) shall nominate patrons, subject to the approval of the Federation of Epe Division Students Representative Council. (herein referred to FEDSRC). Sub-Sec 2. The number of patrons shall not be more than two (2) for each academic session. Sub-Sec 3. All Obas from Epe division are automatic patron of the association. Sub-Sec 4. For the purpose of Section 7 (2), such persons must have been found to identify with the objectives of the association as contained in the Section 3 of this constitution. Sub-Sec 5. Such appointment may be renewed at the expiration of an academic session. Sub-Sec 6. The appointment of a patron shall stand terminated: (a) At his/her demise (b) On his/her removal by resolution of the SPC. HONORARY MEMBERS SECTION 8: Honarary Members Sub-Sec 1. Honarary members shall include past members of the association nominated by the FEDSEC, subject to the ratification of the SRC. Sub-Sec 2. Consideration shall be given to past members of the association who have distinguished themselves in the service of the association. PART II POWERS OF THE FEDERATION OF EPE DIVISION STUDENTS ASSOCIATION LEGISLATIVE POWERS SECTION 9: Legislative Powers Sub-Sec 1. The legislative powers of the association shall be vested in: (a)Federation of Epe Division Students Representative Council. Sub-Sec 2. The power of the FEDSRC to make laws for the peace and other of the association with respect to any matter included in the constitution shall, save as otherwise provided in this constitution, be binding on the FEDSEC. EXECUTIVE POWERS SECTION 10: Executive Powers Sub-Sec 1. The Executive Powers of the association shall be vested in: (a) Federation Of Epe Division Students Executive Council (FEDSEC) THE POWER OF THE CONGRESS SECTION 11: The Congress Sub-Sec 1. The Congress shall be the highest decision making of the association. Sub-Sec 2. The Congress shall have the final say on all association matters without prejudice to the power of the FEDSEC and FEDSRC as stated in the provisions of this Constitution. Sub-Sec 3. The Congress shall have the power to : (a) Debate and pass resolution on any matter of importance to the members of the association. (b) Debate and pass resolution on any matter that is referred to it by the FEDSEC and FEDSRC. (c) Adopt or reject any resolution on any matter that is referred to it by the FEDSEC or the FEDSRC. (d) Dissolve the FEDSEC and FEDSRC. (e) Pass motion of confidence or no confidence on any officer(s) of the FEDSEC or the FEDSRC. CHAPTER II THE LEGISLATURE PART I FEDERATION OF EPE DIVISION STUDENTS REPRESENTATIVE COUNCiL (FEDSRC) A - Composition and Officers of FEDSRC ESTABLISHMENT OF FEDSRC SECTION 12: Establishment of FEDSRC Sub-Sec 1. There shall be a Students Representative Council(FEDSRC). Sub-Sec 2. The practice and procedure of the FEDSRC shall be based on the provisions of this constitution. Sub-Sec 3. In any issues of the FEDSRC where the constitution is silent, the Standing Order shall be referred to. Sub-Sec 4. In any issue of the FEDSRC where the constitution and the Standing Order is silent, the Speaker shall have the final say. COMPOSITION OF FEDSRC SECTION 13: Composition of FEDSRC Sub-Sec 1. The FEDSRC shall consist of two (2) honourable members from each faculty. Sub-Sec 2. Past Speakers of the FEDSRC that have not graduated shall be automatic members (Ex-Officio). DUTIES OF THE FEDSRC SECTION 14: Duties of FEDSRC Sub-Sec 1. The FEDSRC shall: (a) serve as checks and balances on the FEDSEC on all association matters. (b) Have powers to amend, approve or disapprove any policy of the FEDSEC other than any resolution of the congress. (c) Approve all capital expenditures of the FEDSEC before they are embarked upon. (d)Approve the names of Awardees, Honarary members and Patrons. (e) Ratify all nominations for membership or committees. (f) Have power to appoint the Chairman and Secretary of all committees except as stated otherwise stated in the provision of this constitution. (g) Have the power to constitute any Ad-hoc Committee, as it may deem it fit from time to time. (h) have power to summon any member or officer of the union to appear before it on matters relating to the association. (i) Have power to suspend or impeach any member of the FEDSEC that has been found guilty of gross misconduct subject to the provision of this constitution. (j) Have power to suspend or impeach any officer or member of the FEDSRC that has been found guilty of gross misconduct subject to the provision of this constitution. Sub-Sec 2. All correspondence to the FEDSRC shall be written through the clerk to the speaker. Sub-Sec 3. All correspondence from the FEDSRC shall be signed by the Clerk and the Speaker subject to the provision of this constitution. FUNTIONARIES OF FEDSRC SECTION 15: Functionaries of FEDSRC Sub-Sec 1. The Functionaires of the FEDSRC shall include: (a) The Speaker (b) The Deputy Speaker (c) The Clerk (d) The Chief Whip DUTIES OF FUNCTIONARIES OF FEDSRC SECTION 16: Duties of Functionaries of FEDSRC Sub-Sec 1. The Speaker Shall: (a) Be the Head of the FEDSRC (b) Summon sittings of the FEDSRC (c) Preside over sittings of the FEDSRC (d) Have no vote at sittings, except in the case of a tie where his/her vote shall be the deciding vote. (e) Have power to give directives to any member of the FEDSRC and FEDSEC on matters relating to the Association in line with the provision of this Constitution. (f) Represent the SPC at any function of the Association outside the FEDSRC. (g) Be held laible for any omission or commission that may arise in the execution of his/her duties. Sub-Sec 2: The Deputy Speaker Shall: (a) Perform the duties of the Speaker in his/her absence. (b) Conduct all elections in the FEDSRC during sittings. (c) Perform any other duties that may be assigned to him/her by the provisions of this constitution, the Standing Order or the FEDSRC. (d) Be held laible for any omission or commission that may arise in the execution of his/her duties. Sub-Sec 3. The Clerk shall: (a) Be the Administrative Officer of the FEDSRC. (b) Take minutes and record of proceedings in the FEDSRC. (c) Read the minutes of last at the commencement of every sittings. (d) Receive correspondence and issue notice of sittings of the FEDSRC in line with the provisions of section 18 of this constitution. (e) Arrange for proper venue of sittings for the FEDSRC. (f) Perform any other duty that may be assigned to him/her by the provisions of this Constitution, the Standing Order or the FEDSRC. (g) Be held laible for any omission or commission that may arise in the execution of his/her duties. Sub-Sec 4: The Chief Whip Shall: (a) Be the Law Enforcement Officer of the FEDSRC. (b) Have the power to recommend punishment or fine for any erring honourable of the FEDSRC. (c) Be the Mace bearer, carrier and the custodian at all times. (d) Keep close watch, guide and protect the Mace during sittings and at all times. (e) Be the Aide-de-camp of the Speaker. (f) Perform any other duty that may be assigned to him/her by the provisions of this Constitution, the Standing Order or the FEDSRC. (g) Be held laible for any omission or commission that may arise in the execution of his/her duties. OFFICE OF THE AUDITOR GENERAL SECTION 17: Office of the Auditor General Sub-Sec 1. The Auditor General shall: (a) Check and audit the accounts of the FEDSEC and FEDSRC and committees of the association monthly. (b) Publicize his/her Audit Report Monthly. (c) Be a signatory to FEDSA Central Account. (d) In conjunction with the financial secretary of the association prepare the Statement of Account of the Association Monthly. (e) Be nominated in the FEDSRC from within or outside the FEDSRC and appointed by the Speaker. (f) Be person with good knowledge of accounting and/ or auditing in OGSCOHTECH. (g) Be held laible for any omission or commission that may arise in the execution of his/her duties. B - PRACTICE AND PROCEDURE OF FEDSRC SITTINGS OF FEDSRC SECTION 18: Sittings of FEDSRC Sub-Sec 1: The sitting of the FEDSRC shall be convened at least once in two (2) weeks by: (a) The order of the speaker (b) When requested to do so by the President in writing (c) On the written request of a quorum of the FEDSRC honourables as contained in Section 19 of this constitution. Sub-Sec 2. If the Speaker of the FEDSRC refuses to convene a sitting within one week in accordance with Section 18 (1) (b) and (c) of this Constitution, the Deputy Speaker shall have the power to summon a sitting. Sub-Sec 3. If both the Speaker and the Deputy Speaker refuses to convene a sitting within ten (10) days in accordance with Section 18 (1) (b) and (c) of this Constitution, the Clerk shall convene a sitting. Sub-Sec 4. At such sitting, the Speaker and Deputy Speaker shall stand impeached and new Speaker and Deputy Speaker shall be elected within seven (7) days of the sitting. Sub-Sec 5. At any Joint sitting or meeting of the FEDSRC and FEDSEC the Speaker shall preside. Sub-Sec 6. Notice of sitting must be issued at least 48hrs before the time of the sitting. Sub-Sec 7. In case of an emergency sitting, one-third of the total number of honourables shall constitute a quorum. Sub-Sec 8. Honourables of the FEDSRC shall be entitled to sitting allowance. CONDUCT OF HONOURABLES SECTION 19: Conduct of Honourables Sub-Sec 1. Honourables of the FEDSRC shall consult their constituencies prior to any sitting of the FEDSRC. Sub-Sec 2. Any honourable of the FEDSRC that is absent from three (3) consecutive sittings of the FEDSRC without notifying the FEDSRC through written notice shall forfeit his/her seat in the FEDSRC. Sub-Sec 3. In the absence of the Clerk, any honourable of the FEDSRC may be appointed to act in that capacity by the Speaker. Sub-Sec 4. Honourables shall conduct themselves in the manner prescribed by the Code of Conduct of this Constitution and the Standing Order of the FEDSRC. PARTICIPATION OF OBSERVERS SECTION 20: Participation of Observers Sub-Sec 1. The following categories of persons shall constitute observers: (a) Any member of the association other than the members of FEDSEC. (b) Any person(s) given the exclusive permission to observe a sitting by the Speaker. Sub-Sec 2. Observers shall be allowed to observe the sittings of the FEDSRC as long as they do not violate any provision of this Constitution and the Standing Order. Sub-Sec 3. Subject to the approval of the Speaker, an observer may be allowed to contribute on any issue of the FEDSRC when the Mace is laid horizontally. QUORUM of FEDSRC SECTION 21: Quorum of FEDSRC Sub-Sec 1. A quorum of the FEDSRC shall be a simple majority of the total number of honourables of the FEDSRC. Sub-Sec 2. For the purpose of Section 21 (1), a simple majority shall be half plus at least one of the total number of FEDSRC honourables. CHAPTER III THE EXECUTIVE COUNCILS PART I FEDERATION OF EPE DIVISION STUDENTS EXECUTIVE COUNCIL (FEDSEC) Composition and Officers of the FEDSEC ESTABLISHMENT OF THE FEDSEC SECTION 22: Establishment of the FEDSEC Sub-Sec 1. There shall be Federation of Epe Division Students’ Executive Council (FEDSEC) DUTIES OF THE FEDSEC SECTION 23: Duties of the FEDSEC Sub-Sec 1. The SEC shall: (a) Organise and coordinate activities of the association (b) Initiate policies and projects in line with the aims and objectives of the association (c) Ensure that their is peace and order among members. (d) Be the custodian of the Association’s properties. (e) Represent the Association in all matters relating to the Association within and outside the college. (f) Publish the statement of account of the Association at least once a month. Sub-Sec 2. All activities of the FEDSEC that requires capital expenditure must get the approval of the FEDSRC before implementation. Sub-Sec 3. Capital expenditure shall be any expenses above ten thousand naira (N5,000). OFFICERS of the FEDSEC SECTION 24: Officers of the FEDSEC Sub-Sec 1. The FEDSEC shall comprise of the following elected officers: (a) President (b) Vice-President (c) General Secretary (d) Assistant General Secretary (e) Welfare Director (f) Social Director (g) Public Relations Officer (h) Legal Director (i) Financial Secretary (j) Treasurer (k) Sports Director (l) Ex-Officio Sub-Sec 2. Whenever the Epe Division students in other campuses deem it fit to have Sub-chapter, the president shall issue a letter of introduction subject to the ratification of the FEDSEC. Sub-Sec 3. For the purpose of Section 24 (2), the President shall appoint a Coordinator to coordinate all the activities of each sub-chapter. Sub-Sec 4. For the purpose of Section 24 (3), the coordinator shall report directly to the president. Sub-Sec 5. For the purpose of SECTION 24 (1) (L) the immediate past President and Speaker shall automatically be the ex-officios. DUTIES OF THE OFFICERS OF THE FEDSEC SECTION 25: Duties of the Officers of the FEDSEC Sub-Sec 1. The President shall: (a) Be the head of the FEDSEC (b) Serve as a link between the Association, other divisional association, NULASS-OGSCOHTECH, FEDSA NATIONAL, the college as well as outside the college. (c) Coordinate and harmonize the activities of the FEDSEC. (d) Convene and preside over meetings of the FEDSEC. (e) Have power to give directives to any member of the FEDSEC on matters relating to the Association in line with the provisions of this Constitution. (f) Have no vote at FEDSEC meetings, except in the case of a tie where his/her vote shall be the deciding vote (g) Be a signatory to the FEDSA Central and FEDSEC Account. (h) Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 2. The Vice President: (a) Assist the president in the performance of his/her duties (b) Act in the capacity of the President in his/her absence. (c) Carry out other duties as may directed by the FEDSEC, FEDSRC or the provisions of this Constitution. (d) Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 3. The General Secretary shall: (a) Be the head administrative officer of the FEDSEC. (b) Take and keep record of minutes of FEDSEC meetings. (c) In consultation with the President, receive, treat and send correspondence on behalf of the FEDSEC. (d) Be the custodian of the Association library and keep proper stock inventory. (e) On the instruction of the President, call for meetings of the FEDSEC. (f) Carry out other duties as may be directed by the FEDSEC, FEDSRC or the provisions of this Constitution. (g) Be held liable for any act of omission or commission that may arise in the execution of his/her duties Sub-Sec 4. The Assistant General Secretary (a) Assist the General Secretary in the performance of his/her duties (b) Act in the capacity of the General secretary in his/her absence (c) Carry out other duties as may be directed by the FEDSEC, FEDSRC or the provisions of this Constitution. (d) Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 5. The Welfare Director shall: (a)Be responsible for the welfare of the Association members. (b) Ensure that their is peace and other among members. (c) Supervise and manage: i. The Association Properties (d) Monitor the use of all the Association properties and facilities under the approval of the FEDSEC. (e) Carry out other duties as may be directed by the FEDSEC, FEDSRC or the provisions of this Constitution. (f) Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 6. The Social Director shall: (a) Organise and coordinate all social and cultural activities of the Association. (b) Carry out other duties as may be directed by the FEDSEC, FEDSRC or the provisions of this Constitution. (c) Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 7. The Public Relations Officer (PRO) shall: (a) Be the mouth piece of the Association. (b) Be responsible for the proper dissemination of information to members of the Association as relating to the Association. (c) Prepare press release of the Association activities with the approval of the FEDSEC. (d) Be responsible for the production and distribution of the Association’s Publications. (e) With the approval of the FEDSEC, call a Press Conference at least once a semester. (f) Be the custodian of all audio-visual instruments of the Association and maintain proper stock inventory. (e) Carry out other duties as may be directed by the FEDSEC, FEDSRC or the provisions of this Constitution. (g) Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 8. The Legal director shall: (a) Be the Chief Law Officer of the Association. (b) Be the Chief Counsel of the FEDSEC in any suit instituted by or against the FEDSEC. (c) Have the power to register Counsels for and on behalf of the Association. (d) Carry out other duties as may be directed by the FEDSEC, FEDSRC or the provisions of this Constitution. (e) Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 9. The Financial secretary shall: (a) Be the Financial Officer of the Association. (b) Maintain proper book of account and transactions of the Association. (c) In conjunction with other members of the FEDSEC, prepare the budget of the FEDSEC. (d) Receive and account for all monies that accrue to the Association, and remit such to the Treasurer within 48hrs of collection. (e) Publish the Associations statement of account every month. (f) Carry out other duties as may be directed by the FEDSEC, FEDSRC or the provisions of this Constitution. (g) Be a signatory to the FEDSA Central and FEDSEC Account. (h) Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 10. The Treasurer shall: (a) Keep all monies of the FEDSEC. (b) Deposit all monies in the Association’s bank accounts within 48hrs of collection. (c) Be the custodian of the cheque books and vouchers of FEDSA and FEDSEC accounts. (d) Be a signatory to the FEDSEC account. (e) Carry out other duties as may be directed by the FEDSEC, FEDSRC or the provisions of this Constitution. (e) Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 11. The Sports Director shall: (a) Coordinate all sports activities of the Association. (b) Be in charge of all Association’s sport equipments and devices. (c) Represent the Association in any sport activity within and outside the college. (d) Have power to organise any sporting activities subject to the ratification of the FEDSRC. (e)Be held liable for any act of omission or commission that may arise in the execution of his/her duties. Sub-Sec 12. The Ex-Officios shall: (a) Assist the Executive Council members and the Representative Council members in the discharge of duties. (b) To give relevant information for continuity sake. (c) Do such other things that may be assigned to them by the FEDSEC or FEDSRC. MEETINGS OF THE FEDSEC SECTION 26: Meetings of the FEDSEC Sub-Sec 1. The meetings of the SEC shall be convened at least thrice a month by: (a) The order of the President. (b) A written request by at least two thirds of the total members of the FEDSEC. Sub-Sec 2. Any member of the FEDSEC that is absent from three consecutive meetings without any written notice to the FEDSEC to such effect shall be deemed to have relinquished his office. Sub-Sec 3. The members of FEDSEC shall be entitled to a monthly allowance of not less than the annual dues paid per student. QUORUM OF FEDSEC SECTION 27: Quorum of FEDSEC Sub-Sec 1. A quorum of the FEDSEC shall be a simple majority of the total number of members of the FEDSEC. Sub-Sec 2. For the purpose of Section 31 (1), a simple majority shall be half plus at least one of the total number of FEDSEC members. CHAPTER IV THE CONGRESS POWER OF THE CONGRESS SECTION 28: Powers of the Congress Sub-Sec 1. The Congress shall be the highest decision making body of the Association. Sub-Sec 2. The Congress shall have the final say on all Association matters without prejudice to the power of the FEDSEC and FEDSRC as stated in the provisions of this Constitution. Sub-Sec 3. The Congress shall have the power to (a) Debate and pass resolution on any matter of importance to the members of the Association. (b) Debate and pass resolution on any matter that is referred to it by the FEDSEC or the FEDSRC (c) Adopt or reject any resolution passed by the FEDSEC or the FEDSRC. (d) Dissolve the FEDSEC and FEDSRC. (e) Pass motion of confidence or no confidence on any officer(s) of the FEdSEC and FEDSPC. CALL FOR CONGRESS SECTION 29: Call for congress Sub-Sec 1. A Congress shall be called only by: (a) The Speaker of the FEDSRC (b) A written request by the President to the FEDSRC, or (c) A written request to the FEDSRC by at least four (4) members of the Association that cut across all the sub-division in Epe division. (d) For the purpose of Section 29 (1) (c) sub-division in Epe division includes Epe central, Eredo, Ibeju, Ikosi-Ejirin and Lekki. Sub-Sec 2. The Speaker of the SPC shall preside over the Congress until the appointment of a Congress chairman. COMPOSITION OF CONGRESS SECTION 30: Composition of Congress Sub-Sec 1. The Congress shall comprise of all members of the Association. Communiqué Drafting Committee SECTION 31: Communiqué Drafting Committee Sub-Sec 1. The Communiqué Drafting Committee shall comprise of one nominee from each Sub-division present at the Congress. Sub-Sec 2. Members of the Communiqué Drafting Committee shall be nominated by each Sub-division and appointed by the Speaker at the Congress venue.
