Few issues divide libertarians the way the Fourteenth Amendment to the United States Constitution does. What? Is this a real thing? Where did this idea come from? Libertarians are dumb. [T]he Supreme Court would later turn to the Equal Protection Clause and the Due Process Clause to strike down state laws under the Fourteenth Amendment. But the Supreme Court has not stopped at state laws: gradually it has used the Equal Protection Clause and the Due Process Clause as a pretext for regulating private citizens and businesses. The Fourteenth Amendment, which was intended to reduce discrimination, has even been used, ironically, to uphold affirmative-action programs that discriminate against certain classes of people. This is confusing. Theres no case citation, reference, or example to the 14th Amendment gradually being used to regulate private citizens and businesses - because that didnt happen. And upholding affirmative-action programs means that states are permitted to do despite the 14th Amendment what they were permitted to do before its enactment, meaning that the 14th Amendment didnt make anything worse. This article is garbage. It makes the issue (which isnt an issue) seem ambiguous (when its clear-cut) without citing a single, actual, real negative consequence resulting from the Fourteenth Amendment.
