For March 31 (Monday) Final Exams: Class, here are some tips on your final exams tomorrow: 1. The exam will mostly require essay-type answers, i.e., about 12 to 14 questions, mostly 5 points for each one (a few questions for ten points each). 2. The exam will cover, although not necessarily be limited to the following topics: Substantive and procedural due process; eminent domain; equal protection of the laws; searches and seizures (including search warrants, warrants of arrests, and warrantless searches and seizures, and the consequences of invalid searches and seizures); when Article III rights can be invoked (the Marti principle); rights under custodial investigation; the rights of the accused; right against self-incrimination; double jeopardy; right of bail (when it is a matter of right or a matter of privilege; when bail can be availed if the accused is charged with a crime punishable by reclusion perpetua); freedom of expression (focus on the philosophical basis of freedom of expression as articulated by J. Holmes and J. Brandeis, and the clear and present danger test) 3. Some questions are bar exam problems; some problems are my own. 4. In some problems, you will be required to assume the role of a defense lawyer, and asked what issues can be raised to assail the constitutionality of a certain statute, ordinance, or specific actions of public officers/employees in order for you to defend your client.
