From the Woodpile Report: Remus was recently reminded of an under appreciated notion. It amounts to this: legislation is legitimate when it conforms our common understanding of right and wrong. For example, murder and robbery arent wrong because theyre illegal, theyre illegal because theyre wrong. Law which doesnt meet this standard has an intent other than justice. Where laws allow injustice to prevail, law itself will fail over time, as will any regime which comes to depend on it. If it creates a crime where there wouldnt otherwise be one, the law itself is unjust.
