GROUP APPEAL TO THE SUPREME COURT ABSA is claiming that its lost all its documents in a fire in most of its courts papers. Opposing lawyers, who often acts against the banks, are arguing that they need to prove that in court. In other words they shouldn’t be able to take the usual shortcuts (“summary judgement”, “founding affidavits” and so on) when they haven’t ever proved their case. It is in dispute that there was a fire, that your documents were in it, why they didn’t ask you to come in and sign again, etc.). As a result there is now an appeal pending against one particular summary judgment.
