Given the likeliness of a Republican takeover of the Senate and the inevitability of GOP hostility towards the presidents nominee for the soon-to-be-vacant attorney general post, one must wonder if President Obama will once again attempt to ignore Congress and take unilateral action by using the recess appointment power to install Eric Holders successor on an interim basis. Fortunately, because the Supreme Court has already unanimously rebuked the president for abusing this power, any presidential rhetoric will be highly scrutinized and politically risky. Meanwhile, Senator John Barrasso (R-WY) has warned Harry Reid not to attempt to fast-track confirmation hearings during the lame-duck period. If Republicans are successful in preventing the confirmation of an attorney general until the next Congress convenes, they may be able to guarantee the presence of a much friendlier face at the helm of the Department of Justice.
