Goa’s Advocate General Atmaram Nadkarni must be immediately sacked for his very dubious role along with Chief Minister Manohar Parrikar in facilitating and allowing the high profile marriage of former Solicitor General of India Harish Salve’s daughter to be illegally registered in Goa under the Special Marriage Act 1954. Harish Salve is also the Amicus curiae in the infamous Goa illegal mining case currently pending before the Supreme Court. The fraudulent marriage of Saaniya Salve with Armaan Siddiqui which was solemnised on February 24th this year at Vijay Mallya’s King Fisher Villa at Candolim in the presence of the State Civil Registrar was a complete unconstitutional and illegal act, with the blessings of Advocate General Atmaram Nadkarni after an illegal notification issued by the Goa Government on 17th January. An F.I.R will be filed against Atmaram Nadkarni and others who conspired to breach the law. This hurriedly issued fraudulent notification appointing the Civil cum Sub registrars as Marriage officers under the Special Marriage Act 1954 must be immediately rescinded, Even we it has to be challenged in Court so be it. This fraud has serious repercussions on the powers of the State Government to proceed under a Central Law, not extended to the State, as also putting the registrations of marriages under the existing Portuguese Laws in jeopardy. By this illegal notification the State Government has created a situation whereby illegal marriages would continue with no legal status for the couple, which would not only be bad for the women who get cheated by fake marriages, which the Supreme Court intended to curb, but having no legal effect and validity on the relationship of the couple. As the Special Marriage Act, 1954 is a pre-liberation legislation which has to date not been extended to the State of Goa, the January 17th, 2014 notification issued by the Goa Government to facilitate this high profile marriage is therefore illegal and without jurisdiction – there being no valid marriage in the eyes of law. As per the documents obtained under the Right to Information Act, the State Registrar had in his noting on 16th January, 2014 correctly opined that the notification would be a retrograde measure opening a Pandora box. Chief Minister Manohar Parrikar however overruled this and the Law Secretary’s opinion that the Advocate General’s legal advice on the issued be sought. Chief Minister conveniently merely recorded on the file that he had telephonically discussed the matter with the Advocate General while directing that the notification be issued with surprisingly not seeking the Chief Secretary’s’ views which was a complete breach of the Rules of Business. The motives of the Government are questionable in acting so swiftly in processing the file and issuing the notification in a tearing hurry in just one day.India’s highest paid Advocate General Atmaram Nadkarni grossly abdicated in his duty by not placing the correct legal position before the government. Interestingly Saaniya Salve in her notice of intended Marriage submitted to the Panaji Sub Registrar on 20th January 2014 had falsely declared that she was residing in Goa for more than six months while giving her address as 105/106 Altess Manor at Tonca, Caranzalem which is an apartment owned by Advocate General Atmaram Nadkarni. Saaniya Salve did not submit a residence certificate or an affidavit to the effect and the Marriage officer also conveniently failed to demand one, which would be sought from any other ordinary person, without which, the process would never have been done. Advocate General Atmaram Nadkarni’s questionable role and nexus in the whole issue is more than evident. It could not have been a mere coincidence that the venue of marriage the Kingfisher Villa at Candolim is owned by Vijay Mallya whose interests Atmaram Nadkarni has been vehemently defending to save that bungalow from being attached by the banks as part-payment of the Mallya’s debts.
