Goodyear Hearing A Goodyear Hearing allows the defence to request - TopicsExpress

Goodyear Hearing A Goodyear Hearing allows the defence to request an indication of the likely maximum sentence should the defendants plead guilty. The principle was established in a 2005 corruption case against sub-contractor Karl Goodyear at Doncaster Crown Court. Goodyear’s co-defendant in the case had already pleaded guilty and his barrister told the court that Goodyear was “eager” for his own case not to go to trial. He asked for an indication of the sentence he would receive and this was granted. Goodyear hearings can only take place if requested by the defence. And the basis of the plea should be accepted by the prosecution and the defence before the judge gives his indication. It can take place at any stage of criminal proceedings including, as was the case in yesterday’s convictions, at trial.
