To some people’s pleasant surprise, the family-based immigration category for spouses and/or unmarried children (must be under 21 years old) of a lawful permanent resident (F2A category) is current. Thus, if you (or your family members) qualify as potential F2A beneficiaries, you no longer have to endure through the long-wait process. However, you must act quickly, because there is no guarantee as to how long the current status may last. If you are a lawful permanent resident, you may take the following actions for your spouse and/or children to benefit from the current status for F2A: 1. If your spouse or children currently reside in the U.S., you may immediately file for Petition for Alien Relative and Petition to Adjust Status. 2. If your spouse/children currently reside in the U.S., and you had already submitted Petition for Alien Relative, you can file the I-485 petition regardless whether the Petition for Alien Relative is pending or approved. 3. The current status for F2A category means that USCIS had finished processing all the F2A family petitions and eliminated the backlogs.
