To some people’s pleasant surprise, the family-based immigration category for spouses and/or unmarried children (must be under 21 years old) of a lawful permanent resident (F2A category) is current. However, you must act quickly, because there is no guarantee as to how long the current status may last. If you are a lawful permanent resident, you may take the following actions for your spouse and/or children to benefit from the current status for F2A: 1. If your spouse or children currently reside in the U.S., you may immediately file for Petition for Alien Relative and Petition to Adjust Status. 2. If your spouse/children currently reside in the U.S., and you had already submitted Petition for Alien Relative, you can file the I-485 petition regardless whether the Petition for Alien Relative is pending or approved. 3. If your spouse and children are residing outside of the U.S., and you have already gained approval for your Petition for Alien Relative, you may initiate consular processing for your spouse/children in U.S. consulates in their home countries. 4. If your current girlfriend or boyfriend is a foreign alien who currently resides in the U.S. lawfully, you may choose to marry him/her and file for petition. Please note that your spouse or significant other can be of the same gender as you pursuant to the US Supreme Court’s decision overturning the federal Defense of Marriage Act (DOMA) as unconstitutional in June 2013. The current status for F2A category means that USCIS had finished processing all the F2A family petitions and eliminated the backlogs. However, a wave of Petition to Adjust Status will likely hit, and the F2A cases may become backlogged again in the near future.
