BAN KI MOON, Secretary General of the United Nations Your Excellency According to Article 41 of the UN Charter, the Security Council may call on Member States to “apply measure not involving the use of armed force to give effects to its decisions.” These measures are sanctions, which are meant to enforce international law. I urge you to initiate the process of establishing a sanctions regime against Israel for its war crime of collective punishment executed by Israel’s systematic ‘Operation Brothers Keeper’ against innocent Palestinian civilians. Convention (IV) relative to the Protection of Civilian Persons in Time of War. Geneva, 12 August 1949. Article 33. No protected person may be punished for an offence he or she has not personally committed. Collective penalties and likewise all measures of intimidation or of terrorism are prohibited. Pillage is prohibited. Reprisals against protected persons and their property are prohibited. Operation Brother’s Keeper was launched on 12th June in response to the alleged ‘missing’ Israeli settler teens. Israel, without a shred of evidence accused Hamas of the ‘kidnappings’. An accusation denied by Hamas. To date, since 12 June, the Occupying Power, Israel has: Extrajudicially killed seven Palestinians, Ahmed Sabarin, 20 Mohammed Dudeen, 15 Ahmed Fahnawi, 27 Mohammed Tarifi, 30 Ahmad Sa‘id Su‘od Khalid, 27 Mustafa Aslan, 24 Jamil Ali Abed Jabir who suffered a heart attack during an Israel raid on his home, died when the soldiers had prevented him from leaving during the raid to receive treatment. Indiscriminately arrested over 520 innocent civilians, the majority of which are Hamas affiliated. Indiscriminately bombed Gaza injuring civilians including children. Indiscriminately raided, ransacked and looted hundreds of Palestinian homes intimidating and terrifying Palestinian families. As the Occupying Power, Israel has shown blatant disregard for its legal obligations under international law by its use of reprisals against the Palestinian population in carrying out its investigations into the disappeared youths. International Human Right Law prohibits arbitrary or unlawful interference with privacy, family, home and correspondence and affords all persons the right to liberty and security of person, which demands a legal basis for each and every individual arrest. Furthermore Israel has publicly claimed cynical political agenda in that the major operation is meant to achieve three goals: finding the abductees and abductors, weakening Hamas, and thwarting the Palestinian national consensus government. The United Nations has long been negligent in its obligation to protect Palestinian civilians. It is time for the UN to impose sanctions, which are long overdue, against the rogue state of Israel which has for decades disregarded hundreds of UN resolutions and perpetrates daily war crimes against Palestinian civilians.
