Hanya Penderhaka yg undi parti yg Derhaka There have been many interpretations by Constitutional experts whether the Selangor Sultan has absolute power or not to appoint a Menteri Besar of HRHs choosing. Some say the Sultan has and some say no. It depends on which subsection of Article 53 you read. And frankly, I am not sure who is correct and it would be up to the Courts to decide if it ever comes to this. However, Article 51 clearly says that the Sultan has to appoint by instrument under His sign manual and State Seal, a Menteri Besar. However, I did not see any time limit enforced on the Sultan to do so in the State Constitution. Since MB Khalid is still doing a good job and there is still a functioning State EXCO, this means that the Sultan can take His time to appoint a new Menteri Besar - essentially, Action via Inaction. Legally, there is no provision for derharka but politically, it may be poisonous for PKR and DAP. DAP and PKR need to remember that Rukunegara second phrase is Kesetiaan kepada Raja dan Negara and this is ranked higher than the third phrase Keluhuran Perlembagaan . Openly defying a Raja showed disrespect towards an institution the Malays held in high esteem. “For Malays, derhaka is a very sensitive word because it is something that goes against the culture and character of the community.” My belief is that many Malays, especially the conservative ones aligned to PAS, will not vote the two parties who have been confirmed to have Derharka - as doing so would also mean the voters are Penderharka as well. There are 1 million PAS members, who together with their families, may no longer vote PKR or DAP. Therefore, because of Ketums arrogance and stubbornness, DAP and PKR can kiss goodbye to their Ubah and to their 52% (actually 50.87%) popular votes.
