Happy Birthday DAS, is it really !?! As Litigations are filed across the Nations in Various Courts on various issues of DAS... being against Entertainment Tax to be paid by the MSOs, against Billing the LMO subscriber by the MSOs, against Fundamental Right by shutting off Analogue, against the Cable TV Act itself etc. How did CAS which was fair became Unfair DAS?! Who sold off the LMOs benefits towards 100% on FTA, Carriage, Advertisement Revenues etc. Is DAS an Nation Wide scam to benefit handful of Broadcasters and the MSOs?! So much anger and frustrations only growing by the days. No one is really Happy, revenues for all have only gone down, Cable TV Subscriber is yet to be benefited and in fact is suffering as MSOs are arm-twisting LMOs for more revenues every month by shutting off the Sports Channels, switching off STB on pretext of CAF Forms etc. In Mumbai IMCL has shut all Sports Channels without any prior Notice to Subscribers or LMOs since 18th September and Star Sports has a claimed of unpaid dues and so keeps displaying Notice on the Center of the Screen for continues 15 to 20 minutes harassing the innocent Cable TV Subscriber. Scod 18 is doing same to its LMOs in many parts of Mumbai. DigiCable is in deep financial mess, there are speculation on it being able to recover in Mumbai. 1st November Last year DAS was implemented in Phase 1 and till date all MSOs do not have Interconnect Agreements in place with 99% of the LMOs Last Mile Owners across Phase 1 and 2 cities, this is in Gross Violation of DAS Rules. As per TRAI this was the 1st steps that all MSOs where required to take prior to implementing DAS so that Cable Operators would have negotiated Just and Fair Terms before signing the same but the MSOs did not bother to even show the Interconnect Agreements to their LMOs prior to DAS as they were and are still not open to Negotiations or accepting an Mutually Agreeable Just, Fair Terms and Conditions or even Revenue Share. Recently some MSOs attempted to lure few LMOs into sign their Interconnect Agreements on pretext of giving them access to their Subscriber Management System so LMOs can Disconnect and Reconnected their problematic subscribers, LMOs brought this issue to our notice and we have through the Interconnect Agreements of ALL MSOs and found them to be totally one-sided, blindly in favor of the MSOs only, totally against the interest of LMOs and almost like signing a Death Warrant by the LMOs of their hard made Cable TV Business. We are in process of drafting Just and Fair Interconnect Agreements in the interests of our LMOs and ADVISE ALL NOT TO SIGN THE CURRENT INTERCONNECT AGREEMENT OF ANY MSOs TILL APPROVED BY US. If any LMOs have signed the current Agreement without understanding the content and the meaning of the same, if the same is not in the language that you can read then immediately write to the CEO of the MSO that you have signed the same without understating and its implications and mark a copy of your letter to the appropriate Authorities.
