Have spent the last week working on a particulars of claim submission to the tribunal over a disability discrimination issue. It was supposed to be easier, because legal aid suggested they could help. Until they spent a few weeks of the allotted timeframe only to come back and say they cant, because they dont see sufficient prospects of success. Of course they dont. Because they dont understand what the problem is in the first place. Hence why we need specialist services to advance these actions. I have spent the time both drafting the document, and retreating into my own grief because I was there, and it was terrible, and I dont want to relive it. But i have to. Having drawn the legal arguments to their fullest extent and anticipated that they may fail, as others have frequently before, I have advanced the in the alternative arguments. Having argued them, and once again considered what happens if they fail I am now down to the dont be an arsehole argument. Ie the respondent is a massive organisation with all the resources in the world. Their staff all get paid, have a roof over their heads, have food clothing, and probably take holidays. The applicant has been made homeless, cant engage in study, has never worked, and the entire household has had no income during this entire situation. What can you possibly say that makes it acceptable for public funding to be available, and yet the most vulnerable person is excluded from the benefits of basic things like healthcare, education, housing etc. I got that far. And needed to go have a drink. Because shit. Why should this even be an argument we have to have? Send me your energy for tomorrow, when I need to finalise this and send it.
