Here is the Last Will and Testament of Patrick Henry McGraw 1880, February 18 – Patrick H. McGraw - Will Will Book 4 pages 168-170 Chancery Court Probate Adams County, Mississippi LAST WILL AND TESTAMENT OF PATRICK H. McGRAW, deceased In the name of the Father and of the Son and of Holy Ghost, Amen, I Patrick H. McGraw of Adams County, State of Mississippi being of sound mind and conscious of the uncertainty of life do make this my last will and testament in manner as follows, to wit: 1st My soul I humbly commend to the mercy of God! through the writs of the Precious blood of his divine Son and the intercession of the Blessed Virgin: for my body I request an inexpensive burial as may be consistent with a decent respect for social curtains and a plain Head Stone to mark my Grave suitably inscribed hoping that the amount usually expended in funeral & monumental display may in my case be devoted to masses for my Soul & allow for the poor. 2nd The payment of my honest debts which are few. 3rd I give & bequeath unto my nephew Thos. H. Leahy two Thousand Dollars for his use & benefit but in the event of his death before me this bequeath of two Thousand Dollars is to revert to my estate. 4th I hereby direct my Executors to set aside & Interest secured of Three Thousand Dollars the interest of which shall be given to my cousin, Fanny McGraw during her natural life, after her death I direct that said sum of Three Thousand Dollars shall be given to the Roman Catholic Bishop of Natchez or his successor, in trust, officially and in perpetuity to be invested by him & Interest applied for the purchase of Fuel and supplying ____(?) to the poor at his discretion without any regard to creed 5th I give & bequeath unto D. Evercux Hall and St. Mary’s Orphan Asylum of the City of Natchez all my unoccupied & unimproved public lands wheresoever found to be disposed of as their Trustees may deem most advantageous for the cause of charity & education of orphans 6th I give and bequeath to my cousin Margaret Quigles my undivided interest in the property now owned by me & John B. Quigles and Bought of A. Metcalfe, Commissioner and now occupied as an Oil Mill. 7th I desire all my real estate in Natchez and vicinity together with my Plantations in Louisiana & Mississippi to be sold within two years after my death. 8th I give & devise to St. Mary’s Orphan Asylum Ten Thousand Dollars to purchase a Suitable Building and Grounds to establish a Hospital in Natchez or Vicinity under their control management with two pray wards, and one for the Poor, a few to all whites of every denomination. 9th I give to the Brothers of the Sacred Heart of Natchez Five Hundred Dollars for the purpose of library. 10th I give and bequeath to the Mayor & Board of Alderman of the City of Natchez One Thousand Dollars to purchase a Town Clock to be placed in the Tower of St. Mary’s Cathedral and any surplus to be appropriated to the beautifying the public promenade on Bluff. 11th I give and bequeath to the children of John B. Quigles & Margaret Quigles as my residuary legatees of all my estate remaining after the above named bequeaths have been made & settled. 12th I hereby appoint Jno. B. Quigles, Margaret Quigles and Theodore V. Wensel my Administrators and Executors without Bonds. In witness whereof I have hereunto set my hand and Seal this 18th day of February 1880. Patrick H. Jefferies Codicil #1 I hereby ommit and cancel Article No. 4 in my will of 18th Feb’y 1880 in which I left Three Thousand Dollars to be invested for the benefit of Fanny McGraw during her life and I this day make and constitute Margaret Quigles & Fanny McGraw my residuary legatees with the children of John B. & Margaret Quigles as specified in my will of article of No. 11 and I further give and bequeath to my cousin Fanny McGraw absolutely the property on Rankin Street now occupied by Mrs. Woods and Mr. Rutherford opposite Rev. Mericke, Henry B. Dicks, and R.C. Jefferies subscribing witnesses to a certain instrument of writing purporting to be the last will and testament of Patrick H. McGraw, deceased, late of said County bearing date the 18th day of February 1880 who having been first duly sworn disposed and said, that said Patrick H. McGraw, on the day of the date of said instrument of writing to wit: on the 18th day of February A.D. 1880 was more than twenty one years of age and was of sound disposing mind and memory, that these despondents on said last mentioned date, subscribed said instrument of writing this day signed by said testator by his signature of P. H. McGraw, as witnessed thereto, in the presence of said testator and at his interest and request and said despondents further directed and said that they are well acquainted with the handwriting of the said decedent and testator the said Patrick Henry McGraw having seen him write and being acquainted with his handwriting; that they have examined and inspected the said instrument of writing herein sought to be probated as the last will and testament of said Patrick H. McGraw, as well the said instrument dated February 18th 1880 as the instrument affixed thereto, and written on the same sheet of paper, designated as “Codicil No 1” and dated “Natchez March 17th 1880” and signed “P. H. McGraw {seal} “P. H. McGraw {seal}”, and that both of said instruments of writing, the said instrument dated February 18th 1880 and the said instrument dated March 17th 1880. “Codicil No 1” are wholly written and subscribed in the hand writing of the said Patrick H. Foster, Clerk of the Chancery Court of said Adams County in vacation, at the Clerks Office of said Chancery Court in the City of Natchez on this 23rd day of June A.D. 1880 personally appeared Henry B. Dicks and Ralph North subscribing witnesses to a certain instrument of writing bearing date March 17th 1880, said instrument of writing being attached to a certain instrument of writing purporting to be the last will and testament of Patrick H. McGraw, deceased being written on the same sheet of paper and purporting to be a codicil (marked Codicil No. 1) to said last will and testament, who having been first duly sworn disposed and said that said Patrick H. McGraw signed (by his signature P.H. McGraw) sealed published and declared said instrument of writing bearing date March 17th, 1880 and designated as “Codicil No 1” as and for a codicil to the said last will and testament, on the 19th day of March A.D. 1880 in the presence of these despondents; that said codicil then appeared to have been once before already signed by said testator; that said testator was then of sound disposing mind and memory, and more then twenty and years of age and that these despondents describing said “Codicil” as witnessed thereto as the interest and regard and in the presence of said testator and also in the presence of each other on said 19th day of March A.D. 1880, And the said Ralph North further deposed and stated that he is well acquainted with the handwriting of said Patrick H. McGraw, deceased having sustained intimate business relations with him for many years and having very frequently seen him write and having very often read his handwriting; that the said North, has examined and inspected both said instruments of writing above alluded to, and now sought to be probated as the last will and testament and codicil thereto of said Patrick H. McGraw deceased and that the same one wholly written and subscribed in the handwriting of said testators. Sworn to and Subscribed before me ) Ralph North this 23rh day of June A. D. 1880 } Henry B. Foster for consideration of order made at June Vacation 1880 admitting said Will to Probate and granting Letters Testamentary therein and for authority to record said Will.
