Hi Everyone. Please find following information on the Subclass 457 Visa. This is four year temporary visa that requires an employer to sponsor you. Your occupation must be on the Consolidated Skills Occupation List (CSOL) on immi.gov.au The Subclass 457 is a three tier visa; Standard Business Sponsorship, Nomination and Visa Application. The Standard Business Sponsorship (SBS) essentially looks at the business and if it is lawfully operating. This is where the Department require information on training, the financials, ABN/CAN, payroll and staff numbers. The second tier is the nomination. This is where the Department look at the occupation, and if the job duties on the company job description match those on the occupation duties as prescribed by ANZSCO. The final tier is the visa application and this is where we match the applicant’s skills to the occupation. This is where it all ties together. If one stage is refused, then we are unable to proceed to the next stage. In terms of the Subclass 457 visa there are some areas of the criteria that are worth discussing. Market Rate Salary Market rate salary requires that the job salary is equal to or greater than the market rate salary for the occupation. Labour Market Testing Depending on the skill level and occupation, the company may be required to undertake Labour Market Testing (LMT) for a Subclass 457. Income Threshold The current income threshold is $53900 (plus superannuation). Your new job must earn over this salary. Why Local Staff Can’t Fill the Gap The Department do need to understand why an Australian is unable to fill this position. Training Benchmarks Training is key to the application and future temporary and permanent employer sponsored applications. Evidence of the training Australian citizens and/or permanent residents in the last 12 months to the equivalent of 1% of payroll is required to be provided with the application. This evidence should be in the form of training receipts, a training policy and register. This training is required to continue at the same rate of 1% of payroll for Australian citizens/permanent residents for the lifetime of the Standard Business Sponsorship.
