Hi everyone. I rent a property out to 3 tenants who all know each other and are on the same AST as they are all on housing benefit. I have never had an issue with council tax as I understand being on the same agreement means its not classed as a multi-let/HMO. Just rang to query dates for the period Council tax were charging me and the know all lady I spoke to says because of the wording on the agreement (that I will copy an paste in here) it is classed as a HMO. I tried to argue the case with her, but she has exculated it to be looked at and now its at aleast 5 weeks until they will then write to me and I guess Ill have to sit on hold again to argue the toss. The wording I used (see below) was based on what either Jim Halliburton or maybe Matthew Moody or someone said was the right way to go to satisfy both housing benefit and council tax. Just for peace of mind and to prepare for their response, please could someone in the know direct me to maybe the correct peice of legislation or whatever to hopefully support my case. The wording (names have been changed to protect the innocent!!) was this: The Rent shall be £1072.34 pcm, payable in advance. The liability is broken down as follows, Mr Iam overthirtyfive liable for two exclusive rooms (front 2) with shared facilities (£500 pcm) and Mr Late Twenties for a single room with shared facilities at £286.17 pcm and Miss Mid Twenties for a single room with shared facilities at £286.17 pcm.
