Historically, some of our most controversial posts elicit a debate regarding HIPAA Laws. In the following hypothetical scenario, does EPWF violate HIPAA Laws and why? Berkeley County Central dispatches Law Enforcement and EMS to a "Psychiatric Problem" to your next door neighbors house (insert physical address here). The information given by Central to LE and EMS is that there is an 18 year old in the residence whose mother advises is threatening suicide and has barricaded himself inside. EPWF hears this and makes the following post: "Berkeley County **Psychiatric Problem** (Insert your next door neighbors address here) - Mother advises 18 year old has barricaded himself in the residence and is threatening suicide". You see this post and become gravely concerned because you soon realize that the address matches your neighbors address, and that you know, George, the 18 year old son who lives at that residence. You go out on your front porch and watch the police and EMS on scene for quite a while, and then see that the 18 year old is placed on a stretcher in handcuffs and loaded into the ambulance, and that they soon leave. Later on... the paramedics contact City Hospital via Med Radio and advise them that they are "enroute to their facility with an 18 year old male, who has overdosed on heroin because he is suicidal." EPWF updates its followers that "Paramedics are transporting an 18 year old male to City Hospital who has overdosed on heroin in a suicide attempt." You are very concerned about George, and you believe that.... A) Yes. EPWF violated existing HIPAA laws because... B) No. EPWF did not violate existing HIPAA laws... (01)
