Holiday Season PDPA Topic #1 - How consent for the collection, use and disclosure of personal data may be obtained from consumers. Consent may be obtained in a number of different ways. As a good practice, organisations should obtain consent that is in writing or recorded for future reference. • For example, retailers holding membership drives during this holiday season may wish to have their customers tick a box on a form to indicate that they consent to the collection, use or disclosure of their personal data by the retailers for various purposes. Failure on the part of the individual to opt out may not be regarded as consent in all situations. • For example, a retailer mails flyers to its customers indicating that the customers would have agreed to the disclosure of their personal data to third parties unless they wrote back to opt out by a certain date. If the customers do not reply by the given date, the PDPC is unlikely to consider their inaction as giving consent because it may be other reasons such as customers not having opened the mailbox or read the flyer.
