I am so FURIOUS right now! I absolutely HATE the #ESIS Workers Compensation Insurance adjuster assigned to my work comp case from my work accident 2 years ago. Im strongly resisting the urge to reveal her name much less call her by the derogatory name I often refer to her as when speaking of her! Instead of trying to assist me thru this awful recovery process, she has done nothing from day one than to stall, interfere, delay, refuse, cheat, deny, and lie (to name a few) in order to keep her company from providing the coverage they agreed to and which they were paid for. I guess thats why they have been branded as the WORST Work Comp company to have to deal with here in the southeast. They are located in Birmingham. I wish that the Alabama Insurance Board would fine them heavily or better yet, deny their ability to do business in the state! Thru this time weve had a lot of out of pocket expense that theyve never covered and for which they claim isnt reimbursable. Ive even had medical costs that werent covered under the guise of I didnt complain about the issue when I was in ICU, so obviously it wasnt related to the accident. In hindsight, I should have gone on full disability like many had recommended for me to do so that ESIS would have had to pay thru the nose for all the injuries sustained. Then I could have recovered at my own pace, as best as possible, and then gotten on with life as I eased back into the workforce. But thats where my ethics overrode that decision. As it stands right now, ESISs absolute final settlement offer is only pennies to the dollar of what we have already lost, also taking into account the out of pocket costs needed for the surgeries to somewhat correct problems caused by the accident. Several months ago I spoke with a local attorney about my rights in this matter. He informed me that due to state law, we cant sue the insurance company; wed have to sue my former employer. Because of the industry I work in, suing my former employer would be complete employment suicide as I would be branded from that moment on and would be considered to be a liability to any employer in the industry. So now Im between a rock and a hard place. Do I accept this offer and be done with them or will doing so hurt me in the long run? Or do I reject the offer and keep the case open, knowing that doing so will cause a lot of issues between insurance companies arguing whose responsibility it is to pay? Thats what Im fighting right now over the 3 spine surgeries I require to fix some of the problems; the surgery center and doctors wouldnt talk to me until this was resolved so after additional stall tactics by ESIS, I got them to provide a statement that they werent responsible for these surgeries. (Now I just need $4k to schedule the first surgery since my major medical doesnt cover that amount.) I pray that none of you ever have a work related accident, but if you do, that its not ESIS that you have to deal with. They are ABSOLUTELY AWFUL people to have to deal with! And Id recommend that you get an attorney early on. If its where you can sue, thatll be your best chance that youll get your expenses covered, and in a timely manner, and might even have a little that you can pocket for all the trouble.
