I cant take this any longer. I would just like to make a request to all of those folks out there who keep talking about Marshall Law with the Ferguson situation and subsequent events. It would be to your benefit if you learned how to spell MARTIAL MARTIAL MARTIAL LAAAAAAAAAAAAAW so you actually look like you know what you’re talking about. No person named Marshall, is coming to help. Marshal Faulk from the Rams isn’t going to throw down. It’s not the U.S. Marshals either coming to transport prisoners or make federal arrests. The retailer “Marshall’s” isn’t having a Michael Brown BOGO sales event. You’re embarrassing yourselves. Please... stop. Dumb asses. I’ma get all lawyer and skewl ya while I’m at it with a bit of the Constitutional law. It’s good to know. Not many have even bothered to read it. The Constitution does not refer to Martial Law at all, and no Act of Congress has defined the term. It has been employed in various ways by different people and at different times. By some, it has been identified as military law limited to members of, and those connected with, the armed forces. Others have said that the term does not imply a system of established rules, but denotes simply some kind of day-to-day expression of a Generals will dictated by what he considers the imperious necessity of the moment. My references are the following cases: Duncan v. Kahanamoku, 327 U.S. 304 United States v. Diekelman, 92 U. S. 520 Although it’s not a provision in the Constitution, on a national level, Article I, Section 8, Clause 15, grants Congress the power to provide for calling forth the Militia to execute the Laws of the Union, suppress insurrections, and repel invasions. Let it be know that Congress has not once declared Martial Law in our nations history. Article II, Section 2, Clause 1 grants the President as Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States. No direct reference to Martial Law ever established by our forefathers. Supreme Court rulings have opined though case law interpretation that both branches can declare Martial Law. No mention of definition of Martial Law is in a states Constitution either. The power to declare Martial Law is done by the Governor within their own state. Each state Constitution has that provision. BTW - Its the National Guard, or state defense force Home Guards, who come to assist at the State level. Sorry to break it to you, but there will be no air strikes from the Marines, no sniper attacks from Navy Seals, no guerrilla warfare, and both Chuck Norris and Steven Segal declined to help.
