I see Githu Muigai not cooperating with ICC in a clearly ordered arrest warrant against one Walter Barasa. ICC prosecutor convincing the court that Kenya is defaulting in cooperation with the Rome statute despite Kenya signing the treaty voluntarily. This will be the second evidence Bensouda will table. The first was the Hansard of deliberations at the Kenyan Parliament both Senate and House. There may be a 3rd, refusal by Uhuru to appear for trial. With or without the 3rd evidence on non cooperation, I see ICC concluding Kenya is a pariah state and warrants of arrest will be issued for Uhuru and possibly Ruto.
