I spent all day working on e-mail and the schedule. Now, Im cleaning out old e-mail and I found this gem. I added a smaller local band to a show, a pretty good band in my opinion, nice guys in all my dealings with them, so not talking crap about the band, just the sleaziness of their agent and all agents of this ilk in general. It was a random show a weeknight to support some touring bands that needed help. Thought they were just trying to help, then their agent sent me this 5 page contract demanding $750, catering, rider, etc. I loathe when agents say that a band will play, dont discuss any details, then send you a contract like this. The height of sleaze. This is very funny and entertaining to me though. Please enjoy.... No other party is authorized to verify this agreement with particular reference (but without limitations) to fee, percentage calculations, supporting acts, etc., where any conflict or interpretation may exist between this rider and the attached contract, in all cases this rider shall prevail. DATE OF PERFORMANCE: Agreed upon date of LEGION X show performance is –______________ @ ____________________ and guaranteed payment for such is hereby agreed upon at $750.00. A 50% deposit ($375.00) is payable and due to CBM Records LLC within 10 days of receipt of this contract and rider. FINAL PAYMENT MUST BE MADE IN CASH AND ACCOMPANIED BY A CERTIFIED BOX OFFICE STATEMENT PRIOR TO LEGION X PERFORMANCE THE NIGHT OF ENGAGEMENT. 3A) BONUS: Agreed upon back end bonus of ___% (LEGION X) bar take split to be given to LEGION X at close of bar on night of our performance. BILLING: Artist shall receive one hundred percent (100%) Star or Special Guest billing in any and all publicity released and in paid advertisements, including, but not limited to programs, fliers, signs, marquees, radio and television. 5) STAGE SETUP: LEGION X, when headlining, shall have first right of setup for all instruments and properties used in the presentation, and the aforesaid instruments/properties shall not be moved or relocated without the expressed permission of LEGION X. Purchaser will not commit use of LEGION X’s equipment to anyone. SUPPORT ACTS: Prior approval is needed from LEGION X’s management for any support act. LEGION X shall have approval over set lengths, billing, placement of equipment on stage and use of sound and lights. Support acts to be provided and paid for by Purchaser. 6a) PERFORMANCE: a) LEGION X has one hundred (100%) percent control of their performance and production. b) No portion of LEGION X’s performance shall be recorded or reproduced in any way without express, prior written, consent of LEGION X and LEGION X reserves all rights thereto c) LEGION X will begin their performance NO LATER than time stated on contract. d) LEGION X to perform a 50-60 minute set. PASSES: Purchaser shall provide ten (10) complimentary tickets for each performance, in addition to any passes needed for band members and road crew. Passes and tickets shall be given to Artist upon arrival. Media passes do not count against band guest list. CONCESSIONS: LEGION X RETAINS GROSS OF ALL THEIR MERCHANDISING SALES, unless other arrangements have been made and agreed to by LEGION X prior to day of performance. Purchaser will provide one (1) five (5) foot table in a high traffic area (with a backdrop to hang merchandise). ACCOMODATIONS: One (1) double non-smoking hotel rooms at a national hotel chain (Days Inn, Holiday Inn, etc) When required for fly-in shows a 15 passenger van with professional driver is requested to be on call and available to shuttle the band and crew for local airport, hotel and performance needs. STAGE CALL: The following sober personnel must be available to work at the venue on the day of the engagement. Please allow one (1) hour following the engagement to strike and reload equipment. Two (2) stagehands to load equipment in and out. One (1) electrician familiar with the house. One (1) sound engineer familiar with system to operate during Backseat Superstars performance. (If band soundman is not available for performance. One (1) monitor man One (1) lighting technician to operate during Backseat Superstars performance Two (2) spot light operators. 11) DRESSING ROOM CATERING: Dressing room shall be secure, clean and contain a couch or suitable chairs for comfort. Dressing room shall contain one (1) table and adequate electrical outlets and lighting. One (1) cases of domestic beer (preferably PABST BLUE RIBBON, Coors Light or Amstel Light). One (1) bottle of Jack Daniels Black One (1) case of bottled spring water One (1) Deli Platters with assorted white meats (chicken and or Turkey Breast), cheeses with one (1) one loaf of bread. Please include assorted condiments. One (1) 2-liter bottle of Coke. One (1) box of assorted herbal teas (Celestial Seasonings) with hot water source. Please include One (1) small container of honey. Paper plates and disposable drinking cups. 10 Stage Towels Buyouts for up to four (4) meals at time of load-in, $10 per head. After show meal equal no less than (1) XL pizza with Cheese 12) BREACH: In the event of a substantial breach by Purchaser of any of the conditions contained herein, LEGION X may cancel the performance without any further liability to the Purchaser and the Purchaser shall be obligated to pay the full contract price to LEGION X. 12a) Purchaser’s violation of, or failure to perform or fulfill any of the terms, covenants, or conditions set forth in the aforesaid agreement/contract or herein shall constitute a material breach which shall entitle LEGION X not to appear or perform for any performance(s) of the engagement without any liability to Purchaser, and in such event, Purchaser shall be obligated to LEGION X for the full amount of the compensation guaranteed to LEGION X in addition to any and all other remedies for any such breach, which remedies shall be cumulative. Each term, covenant and condition hereof is an essential condition precedent to LEGION X’s obligation to perform and any breach by Purchaser shall entitle LEGION X to recover, without limitation, damages for any loss of good will and injury to LEGION X’s reputation, all costs and disbursements of LEGION X in reliance upon this engagement and reasonable attorney’s fees and costs in connection with any suit arising out of this contract or engagement. 13) This contract was negotiated with specific ticket prices, stated capacity and gross potential. All drum heads will be Remo pinstripes or Aquarian StudioX Series. Heavy duty heads on snare. Absolutely no black dot heads on drum kit. Only cymbal brand substitution will be Zildjian if Sabian is not available. NO other brand is acceptable. Microphones -1 straight microphone with stand and 3 microphones with boom stands (Shure SM58’s preferred) in the front, with 2 monitor wedges for each, 2 side fill monitors for stage, and 2 side fills for the drum monitors & drum riser. -2 Shure SM 57, or similar, microphones for guitar amplifiers -1 EV, or similar, microphone for bass guitar amplifier -Countryman, or similar, Direct Box for bass guitar -Quality mics for drum kit. (EV, AKG, Sennheiser, Shure) -A black backdrop should be supplied by venue. -Please have a good monitor man & soundman. This is very important. - LEGION X will bring guitars, cords & drumsticks 15) Any and all portions of this rider are agreed to by purchaser.
