I support judicial caution in grant of Bail/Bond... Lets have a Bail Act... While I agree the Government needs to get its act together on Security matters and put in place clear strategies and measures to deal with insecurity I share the view expressed on grant of bail/bond to terrorism suspects.... I support judicial caution in grant of bail/bond on the offences of Murder, Robbery with Violence (where arms are involved), Rape, Defilement, Terrorism and Corruption related crimes... There is something quite punitive about being remanded in custody awaiting trial, the idea of having suspected criminals on some of the offences free on bail should be rethought... On rape and defilement especially where its incest its very unfair to release the accused where they live near the victim... We need to have the Bail Act passed into law... Someone Judiciary/National Council for the Administration of Justice/Kenya Law Reform Commission/AGs bring the Bail Bill to Bunge for debate and passage.... We need such a law to guide granting of bail and spell out harsh penalties for jumping bail....
