I voted YES on HB 4787. This bill attempts to calibrate state collections of fees for the Certificate of Need (CON) regulatory program that is administered by the Department of Community Health. CON fees were last increased in 2005 and this increase is meant to adjust actual cost of the program to the fees collected. Total collections had been running at approximately $2.0 million per year while expenses for the program were about $2.7 million. This adjustment will eliminate that gap. Now there is a good question about the fairness and equity of the CON program and it is something that has all sorts of complex side issues that creep up when you look into it a bit more. But since we have this current regulatory environment, we need to do our best to reign in costs where we can, provide oversight and match fees to actual program costs. This bill passed with a vote of 82-26.
