INJUNCTION :— Trade Mark — Infringement of registered trade mark, copyright, passing off and act of unfair competition — Defendant is using marks “BRIGHT” and “FUNS UP” — Deceptively, phonetically and confusingly similar to plaintiff’s registered and well known trade mark “SPRITE” and “THUMS UP” — Three Trade marks of plaintiff i.e. “SPRITE”, “THUMS UP” and “SPRITE” (Label) trade marks under which plaintiffs offer its products are famous and well known throughout globe.
