Im looking a little deeper in the case of Kelly Thomas. Officer Ramos was charged with 2nd degree murder and involuntary manslaughter and Corporal Cicinelli was charged with involuntary manslaughter and excessive force. Their defense attorney John Barnetts opening argument was this: ----- Ramos threat to harm Thomas with his gloved fists was conditional - only if he didnt start listening - and it was clear Thomas didnt take him seriously because he replied, Start punching, dude, Barnett said. (side note: Ramos put on the gloves and said that his fists are getting ready to f*** you up.) Police officers feared for their safety, he said. They were so overpowered that they called a Code 3 — an emergency call for all available officers to respond — three times as they tried to wrestle Thomas into handcuffs, he said. That means officers are in trouble. That means, were losing this fight, Barnett said. The amount of force they were using was not only not too much, it wasnt enough. ----- It wasnt enough?!? How is a cop beating up a man to death not enough?!? Heres an idea for the police departments training syllabus: how about backing off and let Kelly freak out a little bit? He had no weapon; he did not pose an immediate threat to the public. Morons.
