In Marsh v Baxter the WA Supreme Court is to consider whether a farmer should be compensated for the economic loss stemming from his de-certification as an organic farmer after genetically modified seeds from his neighbours farm blew into his crop. The neighbour argues that the farmer should not be able to effectively impose his organic certification standards on his neighbours. The farmer argues that, if he is not compensated, he will bear the burden of the use of GM products but not reap the economic benefits.
