In litigation there is a tool called a deposition, which is testimony given under oath before a trial. Today, I’m serving a notice to take the deposition of a company. The company is required to designate someone who is most knowledgeable to testify in the deposition on the company’s behalf. The representative does not have to be involved with the issues in the litigation, but the company has an obligation to educate and inform the representative before the deposition. If the company fails to do so, and the representative is repeatedly unable to answer questions due to lack of knowledge, the court can sanction the company and force them to produce a knowledgeable person. I view the head of a government agency, and the head of the country, just like the designated representative of a company in a deposition. The agency leader, or leader of the country, has an obligation to be educated about what is happening in their organizations. The fact they were not directly involved is immaterial. And when they appear in front of the press, or testify under oath before Congress, repeated “I don’t know” responses are unacceptable. They need to be informed and accountable. Keep that in mind the next time you see the president at a news conference or an agency leader testifying before Congress.
