In my opinion, President Barack Obama is aptly calling Speaker John Boehners frivolous lawsuit threat, a baseless effrontery of iniquitous political-theater. But what truly infuriates me is the costs associated with symbolic votes and government shut-downs— when the self-proclaimed conservative ideology advertises spending conservation. With more than FIFTY attempts to halt Obamacare and two expensive shut-downs, the price-tag for Conservative political theater is being produced for gimmick-politicking stage, at the cost of all American taxpayers. In a recent meme, created by The Knowledge Movement on Facebook, that has been making a viral circulation across the internet, really may hit the nail squarely on the head reading— Speaker Boehner: You know, I was serious about that suing you thing. Why do you look so smug? The President: Because Im a constitutional lawyer...and youre an idiot. And heres one potential explanation for the presidential meme response: [s]Federal Circuit precedent, which, at minimum, requires that structural discrepancies that lie at the basis of an infringement allegation be explained according to the intrinsic evidence [and not merely formed out of right wing lies or ideological assertion]. Some would suggest that Im out on a limb with a legal concept that wont support my thinking, but Im not alone. Heres a Daily Beast article that addresses my argument, and may explain the Speakers legal team hesitation to file such a lawsuit. if the Boehner lawsuit ends up not being filed, the reason may just be that Boehner’s lawyers’ feared being personally sanctioned under Rule 11.... read on...
