In the interest of consolidation, we are reprinting a factual synopsis of Sundance Vacations. All the following was excerpted from public records and publicly available court documents. (1) July, 2005, Sundance Vacations was investigated by the state of New Jersey for failure to comply with Federal and state minimum wage laws. The investigation resulted in 32 employees being paid a total of $19,762.62 in back wages. The company also paid administrative fees of $1,976.26 and penalties of $3,000.” (Quoted from the New Jersey Department of Labor and Workforce Development, as published on the Internet.) (2) November 6, 2006, a consumer fraud civil law suit was filed against Sundance Vacations, Inc. and Sundance Vacations Network, Inc. The fraudulent misrepresentation claim was filed in the Superior Court of New Jersey, Bergen County, docket number L-8256-06. The civil suit detailed numerous violations of N.J.S.A. 56:8 et seq. of the New Jersey Consumer Fraud Act, by utilizing “false pretenses through the use of unconscionable commercial practices.” (As published on the Internet the case was settled out of Court with the standard no admissions of wrongdoing clause.) (3) August 9th, 2009, in the Philadelphia Sunday Inquirer, consumer reporter Jeff Gelles exposed Sundance Vacations’ questionable marketing and sales practices, in conjunction with the fact that Sundance Vacations’ ignores the Pennsylvania Unfair Trade Practices And Consumer Protection Law (§201-7. (The first five facts preceded the Boycott page!) (7) May 17th, 2012, Kara Kenney, an Indiana Consumer Reporter (RTV6) who also happened to be a Boycott page member, conducts a 3-month undercover investigation of Sundance Vacations’ affiliates in Indiana (Dowd Marketing/SmarTravel/TAN) then airs 7 minutes of that undercover video exposing the questionable marketing and sales practices from A to Z. That particular sales office also subsequently closed. youtube/watch?v=ZvWoqlqsx4g (8) On January 29th, 2013, Harrisburg (PA.) news reporter, James Crummel, ABC News WHTM, airs a video news expose of Sundance Vacations’ questionable marketing and sales practices while referencing the Boycott page. youtube/watch?v=P71JMmpiymA (9) As of this writing, there were approximately 25 known civil law suits against Sundance Vacations for “unconscionable” marketing and sales practices in New Jersey and Wisconsin. The Wisconsin attorney, DeVonna Joy, publicly commented on the Boycott page and was blatantly threatened (personally, in writing) by the Sundance Vacations’ CEO, John Dowd. Consequently, over 100 members of the legal community rallied around Ms. Joy, became members of the Boycott page, and some attorneys publicly commented on the Boycott page while offering pro bono legal advice much to the dismay of the Plaintiff.
