It is very funny to state that the format of filing second appeal as formated by the CIC under Section 19 (3) of the RTI act, and uploaded on the website of CIC, is not in conformation to Rule 8 of the RTI Rules 2012. Earlier, the CIC was not deciding the appeals in conformation of Section 19 (10) of the RTI Act and the CIC (Appeal Procedure) Rules 2005. Besides, the CIC has admitted the disposal of the First Appellate Authority which took 77 days in disposing of the first appeal of the applicant, prima facie against the prescribed mazimum time limit of 45 days under Section 19 (6). The formar Information Commissioner Mr. Shailash Gandhi was not even aware of the mandatory provisions of the RTI Act, which are to be complied with at the time of deciding the second appeal of the applicant.
