Ive been reviewing the Eminent Domain clause in the 5th amendment. Ive concluded that Eminent Domain grants the United States to seize land from private owners for Public Use. The key word here is private. The territory agreed upon in the 1868 Fort Laramie Treaty was agreed upon as a Nation to Nation basis. The United States cannot reduce reservation land without a 3/4th male vote from the Lakota Nation. To do so is an act of Imperialism and Oppression, and not an act of a Federation.
