JAYDEEP MISHRA ON RECENT DEVELOPMENT IN RTI Act CIC in on June 3, 2013 declared six political parties as “Public Authorities” under the RTI Act. The wording in the judgement was “we have no hesitation in concluding that the INC/AICC, The CPI, The NCP, The BJP, The CPI (M), and The BSP have been substantially financed by the government and therefore, are held to be Public Authorities under section 2 (h) of the RTI Act.” But the govt. introduced bill to amend RTI Act to keep political parties out of the purview of the act also has a new section 31 in the principal act which says that the amendment will apply “ notwithstanding anything contained in any judgment, decree or any order of any court or commission ….”and will prevail over “any other law for the time being in force.” But definitely this amendment will defeat the very purpose of the Act. When Political Parties enjoys the freedom from the auditing by the CAG and other Govt Machineries then for whom they are accountable as we all know the money collected by these political parties is the Public Money collected from various resources. But it is totally unfortunate for the democratic structure of this country that the political parties are not ready to disclose the sources of collection and the expenditure of that collection of public money. It is an important fact that the policies of the govt. are affected strongly by the donor of that collection therefore efforts must be made to reveal the nexus between the political parties and the donor of the collection which is used in the election.
