Just a short notice for our new brothers who started to read Quran to understand certain rulings of Shariaa. I got some questions that shows they are confused. I do not discourage it. However, you need to study in a comprehensive manner, I recommend to study it under a Scholar of Fiqh. If you do not understand certain basic principles, you may get confused. I will give two examples here, 1. Aam and Khas - Any Hukum (prohibition or permission) revealed in an Ayah based on a certain event or a certain cause, that Hukum will be applicable as universal rule, not limited to that cause or event only, unless the Ayah itself mentions such limitation. This principle is called Aam or General. An example, in Surah Nisaa Ayah 3, the permission of polygamy was revealed based on the event of Gazwatul Ohud, because many Muslim men became Shaheed, their wives became widow and children became orphan. So, the Ayah permits to marry more than one to resolve such a problem. So, as the principle of Aam, the Hukum (permission) should be taken as general for universal of all places, all time since the Ayah doesnt limit as of specific event or cause (dont forget the condition of justice as the part of the Ayah). 2. Principle of Prohibition and Permisibility: Well, this is pretty simple. Shariaa categories our actions into two. One is called Ibadah and another is Muamalah. Ibadah are those which are absolute worships such as Salah, Zakah, Hajj, Fasting etc. Muamalah is translated as Transactions, all Duniya related works such as dealing with neighbor, family, business, office, banking etc. So, the general principle in regards to Ibadah is, only do what is told to do. Do it the way it is told to do. Dont do anything more or less than what is permitted. If you do any thing more or less or in a different method its called Bidaa (innovation) which is a greater Haram. Example. When you pray you are told to give 2 Sujud in one Rakah, if you give three Sujud thinking its more rewarding, its actually Bidaa and serious Haram. In the matter of Ibadah, no less or no more, do exactly as you are told. However in the matter of Muamalah, the principle is do everything except what is prohibited. As well, do in whatever way you want except in a prohibited way. So, by default all Muamalah is permitted except the prohibition element is present in it. An example, during the time of Rasulullah (SM) and Shahabah (RA), many types of transactions were not there, however you can create these days as many transactions types as you want (as Islami Banks are doing) as long as the Haram elements such as Riba (interest), Gharar (uncertainty), Mysir (gambling) etc. are not present in that transactions. I hope this small note will help you. There are many other principles, and that is why I would recommend to study under a Sheikh who has academic background in Shariaa. Jazakallhu khairan.
