Just wanted to say the I am in Elgin Sheriff Court tomorrow for continual non payment of this ridiculous tax. We have rebuffed Sheriff officers three times in the last two years over a bill of £180.00. It has now ballooned to £490-00 with the parasite charges and was followed by an attachment order. The Attachment order was carried out by the Sheriff Officers who have valued my goods at around £570-00 ..just in case . We sell suitcases, luggage and leather goods. They arbitrarily valued goods in random fashion. Antler luggage was valued at a tenner...as was 5 cities..check Ebay for the difference. I had 14 days to appeal which I have done. I appealed under the Scottish Act that no Professional valuation was done citing the example above. I appealed using information from a HMRC website stating that goods will fail to establish their best price ( due to the fact that 35 items will be sold in Elgin or Aberdeen mart ) due to saturation of the market. I appealed that the open market value that has been attributed to my goods does not match Ebay valuation which is surely the biggest auction site in the world and therefore open market should be what they sell for there. I did not appeal on tools of trade as that would be the shop till and display, but did appeal that we could not be reasonably expected to trade. All this in a town where the council encouraged the setting up of the BID, then having achieved it...removed all our free parking in the same month. All this from the council who, upon hearing that TESCO would vote against it, as is there company policy, decided to re-draw the boundary. The town centre is a Gerrymander. The undertaker in front of Tesco has to pay. The hotel behind has to pay. But Tesco dont. Neither do SKY TV. I wont win. I have no legal representation. I just hope the judge agrees that they have not been professional in their approach, and they have to do the job again which costs THEM money. You cant even get publicity in this town because Elgin BID spend heaps of money at the struggling local rag The NORTHERN SCOT, that they wont print anything negative about them. Its all so Soviet. Democracy.....my arse.
