Kenya needs serious structural changes... These changes cannot be achieved by the existing structural organs including the Executive, Parliament, Judiciary and Political Parties... Peoples direct participation through Referendums is the only viable option left.. There is need for the establishment of NATIONAL REFERENDUM COMMISSION This Commissions mandate should include; (1) Collecting peoples popular opinions regarding national issues on a continuous basis (2) Carrying out surveys regarding such opinions to establish whether they have reached critical level enough to be formulated into Referendum questions (3) Collecting peoples Memorandums regarding such issues (4) Evoking national debate on raised issues (5) Facilitating development of Referendum Draft (6) Presenting the Referendum Draft to relevant organs including Parliament and National Assembly for deliberation (7) Instructing IEBC to carry out National Referendum after due process is followed To achieve these structural changes; A threshold should be established such that if 50% of the maximum possible signatures that can be collected are in favor of the Referendum Draft, then, it shouldnt need approval of Parliament or County Assemblies for it to go to the Referendum. This is informed by the very fact that Parliament/County Assemblies cannot pass a Referendum Draft that is against their vested interests. The PEOPLES SOVEREIGN POWER TO LEGISLATE ON ISSUES OF NATIONAL IMPORTANCE MUST NOT BE TOTALLY SURRENDERED TO PARLIAMENT! Thus, a Provision should be made in the Constitution such that any legislation made by people directly through Referendum or Popular Initiative cannot be amended by Parliament. To guarantee Peoples participation in legislation and initiation of structural changes, REFERENDUM SHOULD ALWAYS BE HELD ONCE IN EVERY FIVE YEARS... It shall be the duty and responsibility of the NATIONAL REFERENDUM COMMISSION to initiate the process of creating the Referendum Draft. This way, Kenyans will be able to achieve the elusive change and override vested interests in the Executive, Parliament, Judiciary and Political Parties who are hell-bent on ensuring that the status quo of poverty, exploitation, corruption and impunity continues unabated... Why NATIONAL REFERENDUM COMMISSION? (1) It is the only least expensive way, (2) It is the only way that doesnt depend on the benevolence of politicians (3) It is the only way to override vested political interests (4) It is the only way that is non-partisan You have a duty to change Kenya for good... support the formation of NATIONAL REFERENDUM COMMISSION... This is the only bloodless revolution that we are capable of engineering against all elements of status quo....
