LHR has succeeded in having a six-year-old stateless child declared a South African citizen in the North Gauteng High Court in terms of the Citizenship Act. Her details will also be entered into the National Population Register and she will be issued an ID number and birth certificate. The court further ordered that a regulation be made to facilitate the implementation of section 2(2) of the Act to enable others to easily apply for citizenship. Until now, the section was unenforceable because there was no form and no knowledge of the section. Home Affairs told LHR they refused to implement this section because “too many people are applying for citizenship in terms of it.”
