Letters to EditorBy : Sangai LettersA rejoinder to the article “Reservation in Admission in MU” by Ch AmubaSir,That in a democratic country like India, citizens are free to express their opinion to address the issues facing the society. However, the All Tribal Students’ Union Manipur (ATSUM) is compelled to point out that the interpretation of the Central Educationallnstitutions (Reservation inAdmission) Act 2006 as amended by the Central Educational Institutions (Reservation in Admission amendment Act 2012) by ChabungbamAmuba Singh (former VCof Manipur University) is not only mis leading, erroneous and void of any rational thinking but is also substantially prejudicial hence createsconfusion in the mind of the common people. His interpretation of the Act has exposed his limited knowledge and understanding of the Constitution.The ATSUM wants to make it adequately clear that it will not remaina mute spectator to such myopic and misleading interpretation of the said Constitutional Act. It has come to a big surprise to the ATSUM and all right thinking person thata person of such stature likes him questioning the implementation of the said Act by the present MU Authority in their collective wisdom. In fact, the MU Authority is just honouring the Act passed by the Parliament of India which came into effect on 19th June, 2012. The Act should have been implemented way-back in the Academic Session of 2013 - 2014 itself. The ATSUM welcomes the MU Authority decision to implement the said Act in 2014 — 2015 Academic Session which stipulates that Reservation Norms in the Central Educational Institutions in the Tribal inhabited States of North East India including Manipur be as per the State Government norms. Indeed, the said Act has done justice to the Scheduled Tribe Students in their pursuit for higher education in Manipur.The former Vice Chancellor has statedthat “There has been never seat (s) earmarked to be filled from amongst the eligible students of Manipur”. Herehe has conveniently and deliberately forgets the fact that MU was a State University earlier before it was upgraded into a Central University in 2005 by an Act of Parliament. Further, his statement that “In any case since Manipur University is not situated in any of the tribal area referred to - The Sixth Scheduled of the Constitution - thereby concluding the first proviso has no applicability in the case of Manipur University,” is absurd and misleading because the Amendment Act of the Central Educational Institutions (Reservation in Admission) Act, 2012 clearly mentioned in the Amendment Section II (I a) - “specified North East Region means the area comprising that statesof Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim, Tripura and the Tribal Areas of Assam referred to in the Sixth Scheduled of the Constitution”. So, thequestion of non applicability does not arise at all. Manipur is a part of the North Eastern Region of India, therefore, it is crystal clear that the said Act is very much applicable to Manipur University and his interpretation does not hold water to any sensible person. The ATSUM is sorry that the former VC of Manipur University is blind in this aspect.The other argument put forth by him that Manipur University has already implemented Central Educational Institutions (Reservation in Admission) Act, 2006 before the immediate effect of the Central Educational Institutions (Reservation in Admission) Amendment Act, 19th June 2012, therefore have no applicability in the case of Manipur Universityis simply absurd and ridiculous. This implies that he is going against the spirit of the amendment provision given in the Constitution of India. ATSUM would like to remind him that Constitution has to be a living body, without this provision (Article 368) no Constitution can function effectively to meet the aspiration of the people.“Chingtamamatani” was only a sloganand that he (the former VC) doesn’t want the ST students to get their due right and rise up. That during his tenure, he never made an effort to fill up the backlog vacancies of ST in teaching and non-teaching, he is not serious to bring out the roster for the teachers and staff now even when his successor is implementing what the Govt. gazette clearly says in the admission process, he raises his opposition. The tribals have been longsufferers in this regard. His article shows that either he lacks understanding of the meaning of the official Gazette or he is totally biased against the ST. As the first VC under the Central University, if he has set up a good foundation there will be no resistance from any corner today! Let him and all who are against such reservation lodged their protest at the right forum in Delhi and there is no use to disturbing the peace and academic atmosphere in MUThe ATSUM would like to reaffirm here that it stand for the overall interest of the tribal students in Manipur and Manipur University in particular and will continue to strive, protect, and uphold the Constitutional Rights guaranteed by the Constitution of India at any cost.Yours faithfully,Muan TombingPresident,
