My Eagle Eyes column last Saturday on Senator Revillas speech, which I consider a let down and offensive and insulting to the public. On the issue of whether the Corona case can be reopened by the Supreme Court, my position: As for the Supreme Court intervening to review the Corona judgment, my opinion is that there is no chance of that happening. Aside from having no legal basis for such a review - Senators Estrada and Revilla themselves admit that they were not influenced by the President’s “requests”, I believe that an impeachment judgment is not reviewable even by the Supreme Court. An impeachment trial is exclusively lodged in the Senate and no other body should be able to intervene, and especially in its judgment. Theoretically speaking, the expanded power of judicial review granted to the Supreme Court allows it to review and reverse judgments by other bodies that are done in grave abuse of discretion but even that is not applicable here. The record of the Corona impeachment would show that the Senate did not act arbitrarily; in fact, in the final stages, there was clearly deliberation on the part of the senator-judges. I always illustrate that deliberation with the final dialogue between Senator Enrile and Justice Cuevas on the distinction between dolo and culpa, effectively checkmating the Corona defense. So does Chief Justice Corona have a recourse? Legally no. But politically and to history, he could take his chances and appeal injustice.
