NEVADA: Auto Insurers Can’t Consider Driver’s 1st Violation of Handheld-Device Law Nevada Insurance Commissioner Scott Kipper notified private-passenger auto insurers in the state that they are prohibited from using as an underwriting or rating factor insureds’ first violation of a Nevada law prohibiting drivers from operating handheld devices -- unless carriers provide the state Division of Insurance supporting loss-experience data. SB 140, a measure passed in the state two years ago, bans the Nevada Department of Motor Vehicles from treating as a violation the first time a motorist is cited for using a handheld device. Kipper indicated in DOI Bulletin 13-007 that auto insurers currently factoring in underwriting and/or rating, including tier placement, first violations of the handheld-device law must contact the division’s property/casualty section immediately to report this underwriting/rating. Carriers applying these violations must submit to the division by Nov. 15 a rate filing with information justifying the use of the violation or with a statement indicating the insurer will no longer apply the criterion as a rating or underwriting factor.
