The ordinance is geared toward regulating yard sales on commercial property, as well as the hanging of yard sale signs. A second reading is needed before the ordinance is passed. In the ordinance, a yard sale is defined as “the outdoor display and sale of tangible personal property, either new or used, at a temporarily established point of sale such as a garage, yard, carport, parking lot or tent. ”This includes garage sales, rummage sales, flea markets, attic sales and other similar descriptive terms. The ordinance states no yard sale shall be conducted on any commercial property within the city. Commercial property is defined as a privately owned location, including buildings, parking lots and adjacent landscaped areas, where business, commercial and professional service activities occur. This includes vacant business locations and empty lots along the city’s business corridor or downtown area. Nothing in the ordinance prevents a licensed business from offering the goods or services for which the business is licensed at said location specified on the license. “However, said business licensee shall not permit a third party to offer items for sale at the business location,” the ordinance states. The ordinance does permit yard sales on public property, such as the city parking lot, under the conditions it is conducted by a non-profit organization. All the proceeds from the sale are to go to the organization to further its goals, programs or operational costs. The non-profit must obtain a permit, which will not have a fee, from the city clerk before conducting a yard sale on public property. As it pertains to signs, the ordinance states no sign advertising yard sales can be displayed more than two days prior to a sale. “The person or organization exercising ownership or leasehold rights over the property on which a yard sale is advertised to be held shall be presumed to have placed the sign advertising the sale that identifies that address or location,” the ordinance states. “The organization identified as holding a sale on public property shall likewise be presumed responsible for the placement of signs advertising a sale.” All yard sale signs must be removed, including all stakes, staples or other mounting devices, with 24 hours of the conclusion of the sale, according to the ordinance. Signs can be posted on private property with permission of the property owner. Signs can also be posted on city property with the exception of any utility poles, street signs, traffic signs or other public device or structure unless the structure’s purpose is to display advertising or announcements. The ordinance states no goods, produce or other items (second-hand or new) will be allowed to be sold on the right-of-way, shoulder or sidewalk of any public highway, street or thoroughfare. This does not apply to a licensed business offering its own products for sale in front of the licensed business location. According to the ordinance, the city does not regulate yard sales on residential property. The sign portion of the ordinance, however, applies to all sales within the city including residential property. “Nothing in this section shall prevent law enforcement from addressing safety issues (e.g. parking, traffic) at a residential yard sale,” the ordinance states. If an individual or organization violates the ordinance, they will be fined no less than $50 and no more than $100, in addition to any court cost, according to the ordinance. Each day the violation is committed or permitted to continue will constitute a separate offense. ------------------- From WYMT One Clay County man faces several charges after police say he was found passed out in a truck in Laurel County. Deputies arrested Stephen Marcum last night on East Laurel Road. They say they found him passed out in his running truck. During the investigation, they found Xanax pills and marijuana. Marcum faces a DUI charge, possession of marijuana, and prescription controlled substance not in proper container charges. ------------------ From the News Journal A Whitley County Grand Jury indicted a Florida man Monday morning, who is accused of stealing about $46,000 worth of iPhones, iPads and iPods from the Williamsburg Walmart in July, but the local charges may be the least of the mans worries. The grand jury charged 32 year old Yohansan Jovan Stewart, with theft by unlawful taking over $10,000 for allegedly taking over $10,000 worth of electronic equipment from the Williamsburg Wal-Mart on July 20. Williamsburg Police Chief Wayne Bird said that Stewart is also a suspect in 20 to 25 similar thefts in Ohio and Tennessee. Bird said about 3 a.m. on July 20, Stewart went to the electronics section of Walmart and smashed the glass of one of the display cases. After removing a number of tablets and other devices, Stewart was able to walk out of the store without incident. Through a review of Walmart video surveillance, Bird said police were able to get the license plate number of the van in which Stewart got into after leaving the store. Bird said Broward County Florida Sheriffs deputies served the warrant after they conducted a traffic stop on Stewart. Stewart waived extradition back to Kentucky. The other cases involved $15,000 to $20,000 worth of merchandise, Bird said. While there are no similar complaints in Kentucky, Bird said it wasnt from a lack of effort on Stewarts part. The same night the Williamsburg Walmart was hit. We believe he unsuccessfully tried to do the same thing at London or Corbin Walmart, Bird said. Stewart may also face similar charges in Georgia, Illinois and Indiana. ----------------- In local Virginia news A photo ID will now be required to vote in Virginia.
