Niki Esser We may be fighting an uphill battle. I intend on going - TopicsExpress

Niki Esser We may be fighting an uphill battle. I intend on going there when I can. In the mean time I did get a reply which appears to have been well thought out and awareness of the problem. I will copy it here: Ms. Esser, the Sevierville Police Department Animal Control Officer (ACO) is aware of the complaints. He has visited this business numerous times over the past several years. For us to take action, we must see abuse or neglect, such as when the basic needs of the animal are not being met (food, water, shelter). When the ACO has inspected the business, he has not found anything that would allow us to cite the business owner. We have also discussed the situation with the Sevier County Humane Society, and it is my understanding that they have also visited the business in the past and not found anything that would warrant enforcement action. The USDA is the permitting agency and it is my understanding that they performed inspections of this business in May 2013 and August 2012. These inspections were in response to complaints they received; the business was not cited in either inspection. I understand your concern and appreciate your feelings. At this point, we do not feel that the law permits us to take action. We will continue to visit the store in the future and take action if we see a violation of the law. Please let me know if you have any questions. Bob Stahlke Professional Services and Public Information Officer City of Sevierville
