Not sure why anyone actually thought racism was ever dead. There are hundreds of millions of people walking amongst us daily who feel just like this woman and far worst. Its ugly, its violent, its pure hate and it is very much alive. I love to occasionally read the comments of videos and articles to see just how some people think...Or NOT! As of late, you can find millions of comments claiming protections under the US Constitution. Two of the most popular are the 1st and 2nd amendments. I’m certain some people mean well when they mention the US Constitution’s various Articles or Sections, specifically the first 10 Articles/Amendments commonly known as the Bill of Rights. But I’m also just as certain that most of the time they have absolutely no idea of what the actual laws are or what the mean. In some ways, NO, saying the infamous “N” word alone isnt illegal. Article [I]/1st Amendment Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. Many of us have seen it and read it, great right? But there’s more to it. Now where the use of something like the “N” word might be dealt with under more than just one Amendment. Two that I would look at are the 1st and 14th. I hope that all of us can agree that the “N” word would be considered “Fighting Words”. There’s actually a Supreme Court case that deals with such terms. The US Constitution actually has statutes that cover the legality of fighting words. Fighting Words -- are those which would likely make the person whom they are addressed commit an act of violence. Fighting words are a category of speech that is unprotected by the First Amendment. Chaplinsky v New Hampshire, 315 U.S. 568 (1942). Fighting words can include lewd, obscene, profane, libelous, and insulting. Words by their very utterance, inflict injury or in history incited an immediate breach of peace and or violent acts. So much like it is very illegal to yell, “Fire!” in a public place; you might indeed find yourself in a legal situation for yelling the “N” word at people in public. Not only is it disrespectful, distasteful and ignorant, it might cause you or others to get their ass beat or worse. Not that I condone violence, but real is real. The women on the video, whomever was on the phone as well as the store itself could find themselves in trouble if things escalated and became violent.
